Wheel Worx Inc. Christmas Giveaway Official Rules

ELIGIBILITY

The Christmas Wheel Repair Giveaway (the “Giveaway”) is open to legal residents of the Commonwealth of Pennsylvania, who are age eighteen or older at the time of entry (“Entrant”). The Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law.

AGREEMENT TO OFFICIAL RULES

By participating in the Giveaway, Entrant fully and unconditionally agrees to and accepts these official rules and regulations (the “Official Rules”) and the decisions of the Sponsor, which are final and binding in all matters related to the Giveaway.

ENTRY PERIOD

This Giveaway begins on specified dates beginning December 13, 2019 at 10:00AM EST and ends on December 22, 2019 at 11:59PM EST (the “Entry Period”)

You may enter the Giveaway in this one way:

Comment on this post making sure to include: 

1 - Your picture or two of the wheel(s) you would like repaired. (Frame photo(s) to include as much of the wheel as possible)

2 - A brief note describing your desired wheel repair.

Entrant is required to have a Facebook social networking account in order to enter the Giveaway.

Any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods.

Only one entry per person, per Prize (as defined below)

SELECTION OF WINNER

Prize winners will be randomly selected from all entries meeting the requirements of the Official Rules. The winner will be selected by 12:00PM EST on the business day following the end of the specified Entry Period at Sponsor’s headquarters.

NOTIFICATION OF WINNERS

Winners will be notified by Facebook Messenger within three days of the Prize drawing, and may be required to sign and return an affidavit of eligibility and publicity/liability release within three days of notification. Prize will be forfeited if a selected winner cannot be contacted, is ineligible, fails to claim all or a portion of a prize, or, where applicable, an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified. In the event of a Prize forfeiture, an alternate winner will be selected from remaining valid, eligible entries that were timely submitted. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the Facebook account making comment on the Giveaway post. Sponsor is not responsible for any change of Facebook account or block due to privacy settings or any other means preventing contact.

PRIZE(S) 

One winner will receive Wheel Worx Inc standard gloss or matte black powder coating service for a set of four (4) stock wheels that the winner provides to Wheel Worx Inc. Mounting and balancing of tires included. Standard 3 day turnaround.

Total ARV $500.00

One winner will receive Wheel Worx Inc. standard Painted or Machined cosmetic repair OR Wheel Straightening for two (2) wheels that the winner provides to Wheel Worx Inc.

Total ARV of Prize $250.00

One winner will receive Wheel Worx Inc. standard Painted, Machined cosmetic repair OR Wheel Straightening for one (1) wheel that the winner provides to Wheel Worx Inc.

Total ARV of Prize $125.00

Sponsor reserves the right to substitute a Prize of equal or greater value in the event the original Prize is unavailable or not suited to the repair required. Not all wheels can or should be repaired. If Wheel Worx Inc. determines a wheel is unrepairable we will allow the winner to provide or designate one other wheel for repair, which must be provided to us within 5 business days of original wheel dropoff. Must be redeemed within 30 days, subject to scheduling availability. No substitution or transfer of Prize permitted except as provided herein. Prizes cannot be applied to prior or currently scheduled repair work. Prizes are not redeemable for cash.

Winner is responsible for delivery and pickup of vehicle and/or wheels to/from Wheel Worx Inc. at 11 Old Willow Mill Road Mechanicsburg, PA 17050. If multiple wheel Prize, all wheels must be delivered at one time for the work to be completed all at one time. Wheel Prize is subject to schedule availability. Wheel repair service must be utilized and completed by March 1, 2020. Winner is responsible for any expenses not expressly included in the Prize description, such as ground transportation, custom color paint(s), shipping and any other expenses.

PRIVACY & CONTENT PERMISSIONS

By entering the Giveaway you grant Wheel Worx, Inc. permission to share your post and any images, graphics and text associated. You understand and agree that Wheel Worx Inc., anyone acting on behalf of Wheel Worx Inc., and Wheel Worx Inc.’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without additional compensation, except where prohibited by law. 

Entrant releases and holds harmless Wheel Worx Inc. for any liability, claims and causes of action based on defamation or violation of rights of publicity or privacy. 

COPYRIGHT INFRINGEMENT

By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property rights of another, You will be disqualified at the sole discretion of Wheel Worx Inc.  If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Wheel Worx Inc. from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Wheel Worx Inc. may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. 

GENERAL RULES

Employees of Sponsor and its parent companies, affiliates, subsidiaries, advertising, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the Giveaway. Participation in the Giveaway constitutes Entrant’s full and unconditional agreement to and acceptance of these official rules. VOID WHERE PROHIBITED.

By participating, Entrants and winners, as applicable, release Sponsor, its officers, employees, and agents (collectively, the “Sponsor Released Parties”), from any and all liability with respect to the Giveaway or the acceptance, possession or use of any Prize. Entrants and winners further release the Sponsor Released Parties without limitation from any liability, damages or causes of action resulting from: (i) any condition caused by events beyond the Sponsor Released Parties’ control that may cause the Giveaway to be disrupted or corrupted; (ii) any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize or participation in any promotion related activity or participation in this Giveaway; and (iii) any printing or typographical errors in any materials associated with the Giveaway. Sponsor’s decisions in all respects relative to the Giveaway are final. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Giveaway in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Giveaway is compromised, without liability to the Entrant. Sponsor reserves the right to disqualify any winner, as determined by Sponsor in its sole discretion. Void where prohibited or restricted by law. All federal, state, provincial and local regulations apply.

All federal, state, and local taxes are the sole responsibility of the winner. Consult with your tax professional regarding potential tax implications. 

NO LIABILITY

By participating, Entrants and Prize winners agree to release, discharge, indemnify and hold harmless the Sponsor Released parties from and against any claims made by any Entrant, prize winner, or any other third parties, related in any way to the operation of this Giveaway, as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize or participation in any promotion related activity or participation in this Giveaway. Sponsor Released Parties are not responsible if Giveaway cannot take place or if Prize cannot be awarded due to travel cancellations, postponements, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

Sponsor’s failure to enforce any term of these rules shall not constitute a waiver of that provision.

Winner acknowledges that the Sponsor Released Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties or guarantees on a Prize (if any) are subject to the respective manufacturers’ terms, and Winner agrees to look solely to such manufacturers for any such warranty and/or guarantee.

CAUTION: ANY ATTEMPT BY ANY ENTRANT TO DELIBERATELY DAMAGE OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT(S) TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION.

DISPUTES AND JURISDICTION

Disputes arising from this Giveaway, or any matter arising therefrom, whether direct or indirect, will be determined according to the laws of the Commonwealth of Pennsylvania, without reference to its conflict of laws principles. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Giveaway shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Giveaway, shall be resolved exclusively by the United States District Court of Pennsylvania or the appropriate Pennsylvania Court; and (iii) under no circumstances will Entrants be entitled to, and Entrants hereby waive all rights to claim, any punitive, incidental and consequential damages and any and all rights to have damages multiplied or otherwise increased; SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and Regulations, or the rights and obligations of the Entrants or the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Pennsylvania or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Pennsylvania.

The list of Prize winners will be posted on the Wheel Worx Facebook page within three business days from the prize drawing.

The Giveaway Sponsored by Wheel Worx Inc. is in no way sponsored, endorsed, administered by, or associated with Facebook. By participating in this giveaway, each entrant and participant completely releases Facebook from any liability associated with this Giveaway.
